Dear Mrs. Kellerhals:
Reference is made to the Department of the Army permit application submitted on behalf of
the Great St. Jim, LLC and received via email April 7, 2016. The proposed project would
involve the repairs of an existing serviceable dock with an RO intake line beneath the decking.
The project is located at the north side of Great Saint James Island, St. Thomas, USVI. Please
refer to case number SAJ-1987-57027 (LOP-JMS) in future correspondence regarding this
project.
While this application was submitted directly to the U.S. Army Corps of Engineers (Corps),
insufficient information was received by the Corps to deem the application complete to conduct
an evaluation. The submitted permit application requests the Corps evaluate the application as a
Nationwide permit #3 for maintenance repairs. However, the RO intake line can't be evaluated
as a NWP and will need to be assessed in conjunction with the proposed dock repairs as a Letter
of Permission (LOP).
The Corps would require additional information to evaluate the project and conduct the
pertinent coordination letters with the federal agencies. Please provide the following
information:
I. Structure drawings on Waters of the Unites States in relation to the Mean High Water
line.
2. Provide as built of the existing dock, as there is variance between the 1987 permit and the
submitted drawings. The permit was granted for a floating dock with two anchors
seaward holding the dock. In 2005, a Joint Permit Application (JPA) was submitted for
either a JD or for both, a JD and a NWP to authorize the existing variations to the dock.
The request was given number SAJ-2005-01574 and it was withdrawn for lack of
applicant information.

3. The new proposed RO Intake specifications, and cross section drawings for the existing
and proposed RO line. The Corps does not have any request or permit given for the
installation of the RO lines.
4. The existing RO Outfall specifications, location and cross section to evaluate if it is
within Corps jurisdiction.
5. A CZM certificate or consistency letter from the USVI Department of Planning and
Natural Resources is required as the project is within tidal waters.
As the application is considered incomplete, no action will be taken on it until the required
information and drawings have been received. We request you provide this information within
30 days. If no response is received, we will assume you have no further interest in obtaining a
Department of the Army permit and the application will be withdrawn. Such action will
constitute final action by the Department of the Army.
You are cautioned that work performed below the mean high waterline or ordinary high
waterline in waters of the United States, or the discharge of dredged or fill material into adjacent
wetlands, without a Department of the Army permit could subject you to enforcement action.
Receipt of a U.S. Territory permit does not obviate the requirement for obtaining a Department
of the Army permit for the work described above prior to commencing work.
