Looking back in the year 2015, a lot of focus was given to “Make in India” and the government has worked quite hard to fulfil some of the utopian requirements of the foreign investors. Later, down in this message, I have briefly touched upon the epic enactments on arbitration law amendments and law on setting up the commercial courts. But in this maze of business focus, I must say the government has not lost sight of social improvement laws too. And I would like to deal with this aspect first. When Prime Minister Narendra Modi decided to spearhead the campaign to improve the child sex ratio by launching the BetiBachaoBetiPadhao scheme in January 2015, it seemed like the harbinger of better policies for women and children in the country. Towards the end of the year, the Rajya Sabha passed the juvenile justice bill, bringing down the age at which juvenile offenders could be tried as adults from 18 to 16 following the Nirbhaya case. While, these are some of the carrots to the social upliftment of the Indian Society, the recent UNDP report on Gender Inequality Index shows India still lagging behind war-torn Syria and Iraq and every South Asian neighbour barring Afghanistan. A lot still needs to be done in India yet. The Prime Minister has been stressing on steps to promote ease of doing business in India. End 2015 and the Parliament cleared two ordinances for speedy settlement of commercial disputes in the country, giving a fresh impetus to ease of doing business. The Union Cabinet, chaired by Prime Minister Narendra Modi, cleared ordinances to amend the Arbitration and Conciliation Act and bring into force the Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts Bill, 2015 [The Commercial Courts law (for short)]. For speedy settlement of commercial disputes, the Cabinet had in August cleared a bill to amend the Arbitration Act to fix a time line for arbitrators to resolve cases. The amendments to the law come amidst keenness of the government to attract the greater foreign investment. Certain foreign companies were said to be hesitant to do business in India because of the long-drawn litigations. Another amendment to the law puts a cap on the fee of an arbitrator. The arbitrator will now also have to spell out if there is a conflict of interest in a case he or she is taking up. The Commercial Courts law will also help in speedy disposal of business related litigations and offers a structure for justice delivered with alacrity. As in house counsel, we are also the keepers and safeguards of the transformation of law in business as well as society. What we need today is to innovate and drive legal upliftment in the society we live in, and not just merely be solution providers. We need to bring about excellence in legal execution while help transform businesses in which we work. We must set benchmarks in sunshine areas of legal knowledge sharing platforms and legal automation.
