Judge Marra decided that CVRA does apply to pre-indictment investigations. He rejects Govt legal theories of
inapplicability. He is allowing further factual development. There is nothing in opinion attributing
wrongdoing to JE - and he does mention that in 2008 the plaintiffs told him that the CVRA action was not an
"emergency" and there was 1 1/2 yrs of inaction. He reserves ruling on our intervention motion and our
opposition to discovery.
