KEY BLOCK----- I have spoken with each of you about the timing of announcements and thoroughness of vetting. I think there is value in laying out the process in writing so you can [] make decisions regarding when to contact potential nominees and get them started as well as when to plan announcements. From the time we tell an individual that they are under consideration and get them the necessary paperwork it is a minimum of 10 days to do a deep dive IF we get the individual's paperwork and documents back in the first 24-48 hours. Some individuals can do this - good staffing, lack of complexity etc - but those individuals are the exception not the rule. More realistically, it will take individuals 3 to 4 days to pull together all the paperwork and complete all the forms. Thus, our own deep dive, if the individuals get us everything in 3 to 4 days, is a 11-12 day process. Although we have several people in "pre-deep dive" and teams up and running and doing as much as they can to hasten the process prior to notifying the individual, there is an enormous amount of work that simply cannot be done prior to receiving forms and documents from the individual. The FBI begins the background check on an individual as soon as the individual completes and submits the SF86. The interims we have done thus far do not short-circuit the time a background takes by much, The value of the background comes from the FBI conducting up to 30 interviews and verifying information at the source such as educational degrees, divorce decrees, child support payments, etc. The FBI has previously told us that a background check takes 30 days, but they could get it down to 20. I am pressing the FBI to move faster and am pressing them to notify us immediately if they find a problem. The FBI has done interim checks on Rice, Steinberg and Napolitano. They will move to the full background next, assuming the MOU has been signed. We are putting Geithner, Orszag and Jones directly into full background. (Emanual already announced so not as relevant to our timing issues.) As of today, none of these three have completed and submitted all their forms. At this point, it is safe to say the only people that will have had or will be close to having had a complete vet by early next week are Napolitano, Rice, Steinberg, Geithner, Orszag and Jones - assuming the last three get us all their paperwork Monday or Tuesday of this week. None of them will have had a full FBI background check. We have several teams doing a pre-deep dive on the following people Holder, Blair, Lew, Locke, Tyson, Wright, Donovan and Daschle. None of them have been contacted to get the paperwork or FBI started. So, I think this situation leaves us with a couple of choices/realities: 1. Announce ASAP, prior to completion of a full vet: This may be a risk we are willing to take. It's true we can find out a good deal of information from the public record, a proprietary data base check (court records, BLJ, credit records, etc), a tax check, our own interview with the individual and checking their references. However, depending on the time alloted, we are likely to have to short-circuit some elements of the process that's been developed, including forgoing some or all of the subject's production of source documents. 2. Contact individuals and put them in the deep dive before they are selected: We could put several people in the deep dive knowing that some of them will not be offered a position in the cabinet. This would allow us to start the process while the deliberations continue and could get us closer to the time we need. The negatives here include spreading information we prefer to hold close, raising expectations, creating opportunities for lobbying campaigns etc. That said, this seems a desirable approach for some individuals with whom these concerns are not as acute. 3. No announcements until deep dives are fully complete: Probably not a realistic option for National Security and Economics, but could be for the rest. We need to decide if we are okay with the risk outlined in 1, if we want to do some of 2, and if 3 is realistic for everything else. Perhaps we should discuss tomorrow when Mike is here.
