Putting aside NPA, and your arguably involuntary waivers, anyone can suit in federal court relying on claims of
2255 i.e. Congress has conferred civil jurisdiction on private parties claiming injury due to violations of the
various predicates. The issue is whether they can meet their burdens of proof.
