We did not release any information =xcept as required by ASU policy. However, it =ppears the =eporting party,
in one instance, may have and that is the =ndividual's prerogative. The University is =ollowing its established policies
and procedures and they have been =rovided to you. But, let me review the =elevant ASU =olicies regarding your note.
Under ACD 401 and its procedures =n P20, the Provost receives the investigative report from the Office of =quity
and Inclusion and makes the determination. There is no =ppeal from the determination. The determination is provided

to =he reporting party, the respondent, the Title IX Coordinator and the =ppropriate administrator (in this case me). The
procedure was =ollowed.
Regarding the second determination you received, the document was sent to the Title IX Coordinator and to
ryself. The reporting party in that instance was the University =i.e,. Title =X Coordinator). This is set forth in P20. The
disciplinary =rocess that I have initiated is a separate policy (ABOR 6-201.J and L) =nd we are following those procedural
steps as well. That process =llows you to contest the sufficiency of the administration's =vidence to support the
disciplinary action of dismissal for just =ause.

Please see the attached =mail and link to Science Magazine article. I received a similar =mail from Peter Aldhous
at BuzzFeed. I am shocked and dismayed by =he release of what I thought was confidential information at the time =y
the University and its subsequent release to the media. My =nderstanding is that the investigation process is subject to
ronfidentiality terms, and moreover, as I have expressed my intent to =ppeal, this process is ongoing. I have numerous
problems with the =nvestigative reports and findings which would be aired at such an =ppeal. In what way is release of
such detailed information in a =etter to the complainant at this time not a violation of =onfidentiality and my rights
therein?

l'= a reporter with Science in Washington, D.C.
l'= in possession of the document with ASU's determination that =ou violated ASU's code of conduct in
grabbing a woman's =reast at a conference in November, 2016 in Australia. I have also =nterviewed a witness to this
incident, Melanie Thomson, at some length =nd will be calling ASU momentarily to ask about the action it is taking =s a
result of these findings.
I am very =uch hoping to get your comment for my article which will post as soon =s this evening
eastern time.
The =uestions I would like to ask are:
What is =our response to this finding? Is it fair? Is it true? Why/Why =ot?
What is right or wrong in the process of this =econd investigation of you by ASU?
Has ASU =aken any official actions against you in recent days, e.g. to terminate =our employment, end
your administrative leave, require sexual =arassment training or anything else that one would typically expect in =his
kind of situation?
Melanie =homson who says she witnessed the breast•grabbing incident in November =016 is asking for a
public apology from you and that you be required to =o to sensitivity training/counselling. How do you respond?
What do you want to add that is not in your 9-page =tatement posted after the BuzzFeed article was
published in =arch?
What else do you want me to =now?
