Page 783TITLE 18-CRIMES AND CRIMINAL PROCEDURE§ 3771(5) LIMITATION ON RELIEF.—In no case shall afailure to afford a right under this chapterprovide grounds for a new trial. A victim maymake a motion to re-open a plea or sentenceonly if—(A) the victim has asserted the right to beheard before or during the proceeding atissue and such right was denied;(B) the victim petitions the court of ap-peals for a writ of mandamus within 14 days;and(C) in the case of a plea, the accused hasnot pled to the highest offense charged.This paragraph does not affect the victim'sright to restitution as provided in title 18,United States Code.(6) No CAUSE OF ACTION.—Nothing in thischapter shall be construed to authorize acause of action for damages or to create, toenlarge, or to imply any duty or obligation toany victim or other person for the breach ofwhich the United States or any of its officersor employees could be held liable in damages.Nothing in this chapter shall be construed toimpair the prosecutorial discretion of the At-torney General or any officer under his direc-tion.(e) DEFINITIONS.—For the purposes of thischapter, the term "crime victim" means a per-son directly and proximately harmed as a resultof the commission of a Federal offense or an of-fense in the District of Columbia. In the case ofa crime victim who is under 18 years of age, in-competent, incapacitated, or deceased, the legalguardians of the crime victim or the representa-tives of the crime victim's estate, family mem-bers, or any other persons appointed as suitableby the court, may assume the crime victim'srights under this chapter, but in no event shallthe defendant be named as such guardian or rep- resentative.(f) PROCEDURESTOPROMOTECOMPLIANCE.—(1) REGULATIONS.—Not later than 1 yearafter the date of enactment of this chapter,the Attorney General of the United Statesshall promulgate regulations to enforce therights of crime victims and to ensure compli-ance by responsible officials with the obliga-tions described in law respecting crime vic-tims.(2) CONTENTS.-The regulations promulgatedunder paragraph (1) shall—(A) designate an administrative authoritywithin the Department of Justice to receiveand investigate complaints relating to theprovision or violation of the rights of acrime victim;(B) require a course of training for employes and offices of the Department of Justicethat fail to comply with provisions of Fed-eral law pertaining to the treatment ofcrime victims, and otherwise assist such em-ployees and offices in responding more effec-tively to the needs of crime victims;(C) contain disciplinary sanctions, includ-ing suspension or termination from employ-ment, for employees of the Department ofJustice who willfully or wantonly fail tocomply with provisions of Federal law per-taining to the treatment of crime victims; EFTA01032499  please note The information contained in this communication is confidential, may be attorney-client privileged, may constitute inside information, and is intended only for the use of the addressee.
