It appears (although I am still reviewing the regs) that Epstein is not barred from participating in the work release program, but he must apply in order to participate, i.e., it isn't automatic. Once the application is filed, the Sheriff's Office makes the decision about whether to allow the work release. spoke with the PBSO person in charge of work release. He said that he had been led to believe that we (the feds) knew that Epstein had applied for the program. He also said that he was threatened with being sued if he didn't approve the placement because others with similar criminal histories had been let out on work release. As part of his program, Epstein is paying off-duty sheriffs' deputies to monitor him while he is on work release — this appears to be in violation of PBSO procedures. I have reviewed my e-mails and have found several that reference calls with Roy and Jack Goldberger where work release was specifically discussed and that lawyers assured us that he would not be seeking work release. was present for some of those conversations. I also have e-mail correspondence where we discussed incarceration and had the word "imprisoned" inserted into the state plea agreement to reiterate our agreement that Epstein would be behind bars for the full 18 months. reminded me that the grand jury has been extended only until January.
