To whom it may concern:
It has come to our attention that you were served with what purports to be a
"Subpoena Duces Tecum" from the Superior Court of the Virgin Islands in a case styled as
Mathew Mahaffey v. Plant Depot, Inc and James Templeton. This case is a case that is
currently before the American Arbitration Association as Case No. 32 180 57 12.
The Federal Rules of Civil Procedure, which are referenced in the "Subpoena
Duces Tecum" have no effect in the pending arbitration. Likewise we are of the opinion
that the "Subpoena Duces Tecum" are improper and create no obligation you to produce
any documents. This Subpoena has not been authorized by any court and has not been
approved, to our knowledge, by any binding, governing body.
This letter is based on the information known to us at this time. We encourage you,
should you have any questions to consult an independent legal adviser.
