COMMITTEE ON HOMELAND SECURITY, JUSTICE AND PUBLIC SAFETY BILL NO. 30-0256 Thirtieth Legislature of the Virgin Islands October 21, 2013 An Act amending title 14, chapter 86 of the Virgin Islands Code by requiring that sexual offenders provide evidence of their address, and permitting that sexual offenders who fail to register on more than one occasion be required to wear a location-transmitting device upon release from imprisonment PROPOSED BY: Senator Sammuel Sanes 1 Be it enacted by the Legislature ofthe Virgin Islands: 2 SECTION 1. (a) Title 14, chapter 86, section 1726 of the Virgin Islands Code is amended in 3 subsection (6)03) by redesignating subparagraph (ii) as subparagraph (iii), and inserting a new 4 subparagraph (ii) to read as follows: 5 "(ii) verification of the address provided which may include a utility bill, telephone bill, 6 television service bill, automobile or life insurance policy, W-2 or other filed tax form, voter 7 registration card, credit card statement, property deed or rental agreement in the Territory, 8 driver's license, or other documents approved by the Attorney General or Deputy Attorney 9 General." 10 (b) Title 14, chapter 86, section 1730 of the Virgin Islands Code is amended by redesignating 11 subsections (b) and (c) as subsections (c) and (d) respectively, and by inserting a new subsection (b) to 12 read as follows: EFTA00620133 - 2 1 "(b) in addition to any other penalty that may be imposed by law, any person required to 2 register under this chapter with two or more convictions for failure to register under this chapter 3 or failing to keep such registration current shall, upon release from imprisonment, be required to 4 wear a location-transmitting device at all times for a period of not less than two (2) years and not 5 more than five (5) years. Any such person who was convicted of a violent sexual offense shall be 6 required to wear a location-transmitting device at all times for a period of five (5) years." 7 BILL SUMMARY 8 This bill amends title 14, chapter 86 of the Virgin Islands Code by requiring that sexual offenders 9 provide evidence of their address, and permitting that sexual offenders who fail to register on more than 10 one occasion be required to wear a location-transmitting device upon release from imprisonment. 11 12 13 14 BR13-0478/August 22, 2013/EEM/Reviewed by MMH 15 16 17 18 19 20 21 22 23 24 EFTA00620134
