The focus at this point is Freedom Plaza (between 13th and 14th Streets), and how it might be divided up between the ANSWER group and the Presidential Inaugural Committee (PIC). We have been discussing the matter with the Park Service and are confident that they are making every effort to ensure that the PIC will have the maximum amount of space on this block, subject to the constraints of an earlier decision by the trial judge suggesting that ANSWER had at least a colorable claim to this area. Our expectation is that any seats lost to the ANSWER group on this block will be made up to the PIC elsewhere on the parade route. Specifically, the parties are attempting to resolve the plaintiff's (ANSWER coalition) application for exclusive use of Freedom Plaza, between 13th and 14th Streets, which would displace approximately 3600 bleacher seats previously available to the Presidential Inaugural Committee (PIC). Our hope is that a reasonable accommodation can be worked out between the parties that would (i) guarantee the PIC will continue to have a substantial portion of Freedom Plaza for its use and (ii) ensure there will be no further court-ordered erosion of the space along the route available for the PIC's exclusive use. The proposed regulation, which we anticipate will be published around the end of this month, will not resolve, or address, ANSWER's claim to Freedom Plaza because its application to NPS is based upon the current regulations that were criticized by the district court. Subject: Proposed Regulations Affecting 2009 Inaugural Festivities John/Melody/Chris, I am writing to alert both transition teams of a development regarding the 2009 Inaugural festivities. In response to an adverse court decision by a federal court in DC arising from the 2005 Inauguration, the National Park Service has issued proposed regulations that will significantly decrease the amount of space along Pennsylvania Avenue that will be controlled by the Presidential Inaugural Committee (PIC) for the presidential inauguration on January 20, 2009. The court found that the NPS impermissibly favored the PIC over protesters in giving the PIC exclusive access to much of the space along the parade route. In an effort to satisfy the judge's concerns, the Park Service proposes to reduce the amount of space along Pennsylvania Avenue available for the exclusive use of the PIC by 75% -- from 47% of the available space to 13%. The remaining space would be made available to the public. The historic exclusive use for the Inauguration of the area in front of the White House and in Lafayette Park will be unaffected by this proposed regulation, except for a small corner of Lafayette Park. The judge was influenced in part by the many empty bleacher seats along Pennsylvania Avenue that were observed during the 2005 inaugural parade. Consequently, the proposed rule also would open "ticketed" seats up to the public if they are not filled within 10 minutes of the time the parade is scheduled to pass by that particular block.
