*** BRIEF OVERVIEW "*
Between 9 p.m. on 05/07/2008 and 2.00 a.m. on 06/07/2008, the Accused and the
Co-Accused left a party on King Street, PORT PIRIE in company with another male, 9c
4 Justin BORLAND. Between the stated times the three (3) males walked along Three
Chain Road, Main Road, and Nary Elie Street, PORT PIRIE. The Accused and the
Co-Accused smashed a total of ten (10) windows at five (5) different loctaions
in PORT PIRIE. BORLAND witnessed the Accused and the Co-Accused smash the
windows and has provided a statement to Police on video. As a result of
enquiries, police arrested the Co-Accused on 09/07/2008. The Accused who lives
in Victoria, was subsequently arrested on the 02/10/2008 while he was back in
PORT PIRIE visiting his mother. The exact damage in unknown, but in the vacinity
of $5,000.

pavers through the windows. The Accused and the Co-Accused did not have
permission to smash the windows. The cost of the damage is estimated to be in
excess of $5000.

the Caltex Service Station by throwing pavers through the windows. CCTV footage
of the incident has been recorded and passed onto Port Pirie Police. No person
had permission to damage the windows and the victim is seeking compensation for

Count 2.
The witness in this matter is Justin BORLAND. He states that at about 9.00 pm on
Saturday the 5th of July 2008, he was dropped off at a party on Three Chain
Road, PORT PIRIE by his mother. He states that he was in company of the Accused
and the Co-Accused at this time. He states they then attended a party on King
Street, PORT PIRIE.
The witness states that while he was at the party, the Accused approached him
and told him to come and have a look at some windows he had smashed. BORLAND
states he left the party with the Accused and the Co-Accused. BORLAND states he
walked with the Accused and the Co-Accused from King Street to Main Road PORT
PIRIE.
BORLAND states that while he was walking with the both the Accused and the
Co-Accused on Main Road, PORT PIRIE he witnessed the Accused smash the shop
front window at the front of a business premises. He states the Accused backed
up to the window and forcefully kicked the window causing it to smash.

BORLAND states that he continued walking with the Accused and the Co-Accused on
Main Road towards Three Chain Road, PORT PIRIE. He states he was present when
the Accused and the Co-Accused smashed a pane of glass at the Victim Support
Office, Main Road, PORT PIRIE.

BORLAND states that he continued walking with the Accused and the Co-Accused on
Main Road towards Three Chain road, PORT PIRIE. He states as the approached the
'Tile' business on Main Road, The Accused and the Co-Accused picked up a brick
each from premises. He states they then continued walking towards the Caltex
Service Station which is on the Corner of Main Road and Three Chain Road.
BORLAND states he ran past the front of the Service Station through the bowsers
and stood near the roadway on Three Chain Road.
BORLAND states he saw the Co-Accused smash the front window at the Caltex
Service Station by throwing the brick through the window. He further states the
Accused smashed the side widow by throwing a brick through the window. After the
Accused and the Co-Accused smashed the two (2) windows an alarm sounded inside
the building. BORLAND states that they all ran south along Three Chain Road back
towards Ring Street.

Port Pirie Tourism and Arts centre. He states the Accused climbed onto the rail
and kicked his legs out at the door, smashing the window.

On Sunday the 6th of July 2008 and Monday the 7th of July 2008, Port Pixie
Police received five (5) separate reports of property damage that occurred
between 9.00 pm on Saturday the 5th of July 2008 and 2.00 am on Sunday the 6th
of July 2008. Police Report Numbers: 09/L45448, 09/L45651, 09/L46565, 09/L45515
and 09/L46768 refer.
Police received CCTV footage from the Caltex Service Station. This footage shows
the Co-Accused smash the front window at the Caltex Service Station by throwing
a brick through the window. The footage also shows the Accused throw a
brick/paver through the window on the eastern side of the building. The CCTV
footage has been saved onto a DVD. The DVD has since been booked onto the Police
Property management System. Property number 09/A22327 refers.

attended Unit 1, 294 Senate Road, PORT PIRIE to speak to the Co-Accused in this
matter. Police (NICHOLSON) spoke to the father of the .2O%6
Co-Accused at this time. advised Police
he would convey the Accused to the Port Pirie Police Station to be interviewed
by Police.
At about 9.44 am on Wednesday the 9th of July 2008, Police (NICHOLSON/ROWBOTTOM)
conducted a video interview with the Co-Accus 4n *ha Dann 94n4a Police
intery esence of his father, and his

with 5 counts of Property Damage.

the interview, the Accused was subsequently arrested and charged with 5 counts

The Accused stated he does not remember smashing any windows on any shop fronts
along Main Road, PORT PEWS.
Count 3.
The Accused stated he does not remember smashing any windows on any shop fronts
along Main Road, PORT PIRIE.

The Accused made full and frank admissions in relation to Count 4. He stated
that was the only incident he remembered on the night in question. He stated
that he was walking east along Main Road, PORT PIRIE in company with the
Co-Accused, and when he and picked up a
paver from the 'tile' business next to the Caltex Service Station. He stated
that he and ran towards the shop front and smashed one window each by
throwing the payers at the window.
He further Stated he did not have permission to damage the property and that he
and should be responsible for paying for the damage. He does not know
why he did it and admits it was a stupid thing to do. Tho Accused stated he knew
it was illegal to damage property without the owners permission.
Count 5.
The Accused stated he does not remember smashing the windows at the Tourism and
Arts Centre on Mary Elie Street, PORT PIRIE. The Accused stated he did not walk
past the Tourism and Arts Centre on the night the windows were smashed.
