In his letter to Judge Spitzer (copied below), Dr Zernik notes that it now midway through the 4-year cycle of the UN Human Rights Council UPR. Therefore, he requests Judge Spitzer's response on the note, included in the 2013 UPR Professional Staff Report, regarding "lack of integrity in the electronic record systems... of the courts in Israel". The note in the 2013 UN UPR Report refers to the Human Rights Alert (NGO) submission to the Human Rights, which details the development, implementation and operation of new IT systems, lacking in integrity, in the Supreme Court, the district courts and the detainees courts. The request also refers to a recent report, published by the European Conference on e-Government, subject to international academic peer review, regarding "Fraudulent, new IT systems of the Israeli courts..." The request also asks regarding corrective measures intended by the Administration of Courts, if any. The Administration of Courts confirmed receipt of the request. (מצורף [iv]) כנס זה כלל ערוץ מיוחד לדיון במערכות מידע של בתי המשפט באומות שונות. המאמר עבר בדיקת עמיתים אקדמית, אנונימית, בינלאומית, והליך נוסף שבו היו מעורבים הנואמים המרכזיים בכנס (מומחים אקדמאים למערכות מידע בעלי מוניטין בין לאומי), ככל הנראה לנוכח הכותרת יוצאת הדופן. במידה שתמצא שיש ממש בכשלים של מערכות המידע של בתי המשפט בישראל, המתועדים במסמכים המצורפים, אבקש שתציין גם צעדים מתקנים שבכוונתך להפעיל בעניין זה, אם בכלל. המסמכים המצורפים מתייחסים רק לכשלים שהתגלו ותועדו במסגרת בדיקת מערכות וכריית נתונים. השפעתן של מערכות אלה על ניהול הליכי המשפט בתיקים עצמם מפורטת בסדרה של חקירות תיקים. דוח בעניין זה יועבר לתגובתך בעתיד, לפני הגשתו לבדיקה התקופתית הבאה של זכויות האדם בישראל על ידי מועצת זכויות האדם של האו"ם. על הכותב: דוחות שחיבר דר' צרניק בעניין מערכות מידע וזכויות האדם נכללו בדוחות הביקורת התקופתית של מועצת זכויות האדם של האו"ם על: > * ארה"ב (2010), עם ההערה: "שחיתות בתי המשפט ומקצוע עריכת הדין, ואפליה באכיפת החוק בקליפורניה"; > * ישראל (2013), עם ההערה: "חוסר יושרה במערכות הכתבים האלקטרוניים של בית המשפט העליון, בתי המשפט המחוזיים, ובתי הדין למוחזקי משמורת בישראל", וכן > * ארה"ב (2015), עם ההערה: "HRA NGO המליץ על תיקון יושרת מערכות המידע של בתי המשפט, תחת סמכותו של הקונגרס, במטרה להפוך מערכות אלה שקיפות לציבור ככל האפשר ". ספר על "למידה ממוכנת" מצא את הפעלתן של שיטות כריית נתונים בתחום זכויות האדם ע"י דר' צרניק אחד מן "השימושים הראויים לציון", וסיכם כדלהלן: [v] כריית נתונים של כתבים ממשלתיים - במיוחד כתבים של מערכת המשפט (לדוגמה: בתי המשפט, בתי הכלא) - מאפשרת את גילויין של הפרות שיטתיות של זכויות האדם בקשר ליצירתם ופרסומם של כתבים משפטיים חסרי תוקף או הונאתיים על ידי רשויות שלטון שונות.
