Dear Marie,
I am receipt of your letter dated Sept 18.. I would like to correct the misstatements ,
Frst , Epstein was treated no differently than any other state sentenced prisoner.
His serving thirteen months for the eighteen month sentence was exactly the same
length of time as every other offender. Exactly to the day. His work release was a
Sheriff program that in your own email, said it was up to the Sheriff to decide
whether or not he was elegible, . His gain time calculation is available to you upon
request To somehow intimate that that was not part of his sentence , is troubling.
Second , to suggest he was caught walking on the beach, is again an allegation that is
easily disproven. He was never on the beach, this is also easily verified. Not only
did he specific authorization to walk to work, This was verified by the police with
his probation officer., but the street where he was stopped was in a direct route to
his office. He was stopped on south ocean blvd and Clarke, to avoid walking
through town , he took a street one block east with less people. No more no less„ it
was fully investigated , and he was found in total compliance with his probation
restrictions.
The plea agreement makes note that it was his intention to stay in palm beach,
but contrary to your assertion, the Judge actually said at the plea colloquy tha if you
move in the interim. Check with the local municipalities, regarding registration
requirements. Transfer of his probation is no more or less, than other offenders. I
have read the NPA , and can find no prohibition against transfer. IF you read it
differently , please describe your basis for doing so.
More importantly your comment with regard his obligations under 2255„ Mr
Epstein is committed to living up to all aspects of his agreement We find many
terms of the agreement ambiguous, and would again request a meeting where we
might come to a resolution.
