Banyan is expressly authorized to record and foreclose any such lien, and Banyan is not required to possess the aircraft at the time of lilingnecording of any such lien. Lack of possession of the aircraft shall not be a defense to the enforcement of any such lien. which shall be deemed to be a valid and incontestable lien against the said aircraft (notwithstanding any provision of law to the contrary). In the event that it becomes necessary for Banyan to employ the services of an attorney to enforce its rights hereunder or to collect any balance due, the owner of the said aircraft shall pay all court costs and attorney fees incurred by Banyan in addition to any principal and interest adjudged to be due Banyan.
