The answer is that a defendant can't be subject to more punishment than whatever the penalty was at the time of the offense. So, normally we're prosecuting people who committed crimes recently, so whatever the current law is applies to them. Here, the maximum sentences for these offenses were different back in 1994-97, which is the time period of our charges, and the maximum sentences were less at that time than they are now.
