We are in full support and seek to improve working conditions for the
in-home care providers who are precious to seniors and people with disabilities
living active lives in the community. To this end we believe that a
bifurcated approach to the overtime law is the best solution.
In private sector nursing homes and nursing agencies, the old concept of
liability makes it such that these organizations cannot leave their client
alone for an hour. This makes it a bad working condition for workers who
cannot get lunch breaks or rest breaks. We entirely support this kind of
labor protection in the private sector where liability requires
round-the-clock attendance to one's patient.
But as is so much the case in in-home care there is no one-size-fits-all.
Models for one type of client can be beneficial for one type of client
while being very detrimental to another. In the case of publicly funded
in-home supportive services in California, there are few caregivers who get paid
for more than eight hours a day. That leaves 16 hours a day for meal
breaks and rest time, which is clearly more than enough. There is no such
liability requirement that makes the provider have to stay with the consumer 24
hours a day in the publicly funded in-home supportive services program.
Furthermore and most important, overtime laws in these publicly funded
programs could have been extremely detrimental effect by cutting some
providers income almost in half and providing no benefit at all. Almost 70% of
caregivers are family providers. Those caregivers could see their hours cut by
close to one half, because in the cash-strapped state like California, the
chances of the state paying overtime are slim to none. What would likely
happen is what is happening in many other states in this economic crisis
which is that no one is being given more than 159 hours of work on month so
that overtime and benefits do not have to be paid. There could be
widespread misery, if suddenly a large amount of in-home supportive services
providers or family members or who live in with a severely disabled people saw
their incomes cut in half. If the state were somehow to pay time and a half
for hours over 159 hours a month, then consumers would see a dramatic cut in
service hours because of the finite revenues in the budget. There would
be no one who would benefit from this arrangement except possibly the unions
who would now collect two and three union dues from one consumers home.
In summary, while we are in full support of it decent working conditions
in terms of meal and rest breaks, which there is more than adequate time for
in the IHSS program, we feel that to pay overtime in the publicly funded
in-home supportive services would not occur and would instead results in a
drastic cut in hours making it difficult for some families to survive
without adequate income and requiring them to have strangers provide care which
they may not want.

The White House asked the National Council on Disabilities to provide
input on the draft federal regs on overtime. I was invited to be in the
roundtable discussion and received the agenda & list of participants this
morning. The agenda indicates that the final draft reg has been submitted to OMB
– so the discussion is shifting from what is in the draft reg to actual
implementation. The draft final reg under review by OMB is unchanged from the
drafted we reviewed last Spring (attached are our comments & the draft fed
regs).
The employer options for implementation are laid out in the regs: (1) pay
overtime to all personal care assistants, (2) pay overtime to some
providers based on criteria that can be set by the employer, or (3) limit the
amount of compensable time providers can work.
It is my understanding that OMB has 90 days to review the draft reg and
the clock started 1/15/13 – to the deadline for OMB action would be around
4/15/13. The effective date is normally 30 days after the final reg is
published in the Federal Register. The worst case scenario seems to be that
fed regs would go into effect in May. Counties obviously have no fiscal
exposure because of the new MOE. But the impact on consumers, providers,
counties and Public Authorities could be huge. I’ve reached out to the state to
talk before I participate in the roundtable on January 30th.
