THIS CAUSE is before the Court on Defendant's Motion for Modification and
Reconsideration of Order entered by Magistrate Judge dated June 1, 2010 and alternative
Appeal of Order (D.E. #559) and Amended Motion for Modification and Reconsideration
of Order entered by Magistrate Judge dated June 1, 2010 and Alternative Appeal of Order
(D.E. #560). Having reviewed the pleadings filed incident to these Motions and being
otherwise duly advised in the premises, it is hereby
ORDERED AND ADJUDGED that said Motions, (D.E. #s 559 & 560) are DENIED.
For the reasons stated in the undersigned's June 1, 2010 Order the Court finds the subject

book undeniably properly discoverable and rejects Epstein's argument that the book is
non-discoverable because it contains "confidential trade secret" information. To the extent
Epstein wishes to file an appeal of this Order he may do so in a separate pleading directed
to the District Court. In accordance with the above and foregoing, it is hereby
ORDERED AND ADJUDGED that said Motions (D.E. #s 559 & 560) are DENIED.
