Welcome to the CNN Politics Nightcap and good Monday evening from Washington. Bernie Sanders is fighting to lock down his legacy in the Democratic Party, and the GOP donor base is starting to warm to Donald Trump. Meanwhile, Paul Ryan is leaving himself an out on the convention. Your bartender is Tal Kopan (http://www.cnn.com/profiles/tal-kopan?sr=nl_pol_050916_talkopan) filling in for Eric Bradner (http://www.cnn.com/profiles/eric-bradner?cid=nl_pol_071915_profile?sr=nl_pol_072215_bradner) . The tip jar: [email protected] (mailto:[email protected]) .
** Paul Ryan gives Donald Trump an out on convention
------------------------------------------------------------
Paul Ryan says if Donald Trump asked him to step aside as chairman of the Republican National Convention, he'd oblige, setting up an out as the two are continuing their chilly standoff. Ryan made the comments in an interview (http://www.jsonline.com/news/statepolitics/ryan-says-he-would-step-down-as-convention-chair-if-trump-asks-b99721843z1-378661491.html) with the Milwaukee Journal Sentinel published Monday. He was asked if he would give up the post should Trump ask.
"He's the nominee. I'll do whatever he wants with respect to the convention," Ryan told the paper. Meanwhile, the two men are set to meet in Washington on Thursday to try to thaw their relationship, which readers of Nightcap know has been tense since Ryan told CNN's Jake Tapper last week he wasn't ready to support Trump.
Ryan's comments are another sign of how Trump's ascent to the top of the GOP happened so fast that even the billionaire himself was surprised. And the whipsawed GOP establishment now faces immediate choices -- none of which particularly appeal to them. CNN's Steven Sloan and Rachel Smolkin have more (http://www.cnn.com/2016/05/08/politics/donald-trump-gop-civil-war/index.html) .
It's not all bad blood, though. Trump distanced himself from surrogate Sarah Palin on Monday after her weekend comments that she'd support Ryan's primary challenger this summer. Trump called Palin "very much a free agent" and said he wasn't aware of her plans to back Ryan's opponent before she revealed them. Your host has more (http://www.cnn.com/2016/05/09/politics/paul-ryan-donald-trump-convention-chairman/index.html?sr=nl_pol_050916_ryantrump) .
** Bernie Sanders leaves his mark on the Democratic Party
------------------------------------------------------------
As Bernie Sanders and his supporters deal with the likely eventual nomination of Hillary Clinton, his candidacy is set to leave an indelible mark on the party. Even poised for wins Tuesday, the math works against Sanders in the nominating process -- but he has brought a generation of energized supporters and pulled the party's ideological center along with him.
CNN's MJ Lee reports (http://www.cnn.com/2016/05/09/politics/bernie-sanders-democratic-party?sr=nl_pol_050916_bernielegacy) the effort now is to make sure things stay that way. As he says he plans to campaign all the way to the convention (and that he intends to still win the nomination), Sanders has also cut back staff and slowed the campaign pace. He sent a letter on Friday to the Democratic National Committee demanding his voice be adequately represented at the party's convention in July.

** Trump calls Clinton an 'enabler' and doubles down on attacks
------------------------------------------------------------
Donald Trump on Monday doubled down on his attacks on Hillary Clinton over her husband's infidelities, calling her an "enabler" and saying the attacks are only payback. "It's only retribution for what she said. She is playing the women's card to the hilt," Trump told CNN's Chris Cuomo in a charged exchange on "New Day." Trump has been bringing up the criticism on the trail, accusing Clinton at a campaign rally of going after the women who accused Bill Clinton of harassment. "She was an unbelievably nasty, mean enabler, and what she did to a lot of those women is disgraceful," Trump said.
Initially Monday, Trump tried to dodge the question, telling Cuomo sarcastically it was "a nice way to start off the interview" and saying he's been focusing on issues and bringing up Bill Clinton's infidelities "very little." Clinton declined to respond at a campaign stop in Virginia on Monday. "I have nothing to say about him and how he's running his campaign," Clinton said. "I've been clear that a lot of his rhetoric is dangerous." More (http://www.cnn.com/2016/05/09/politics/donald-trump-hillary-clinton?sr=nl_pol_050916_trumpclinton) , from CNN's Tom LoBianco.
** Big donors get on the Trump train
------------------------------------------------------------
Two major GOP donors got on board with Donald Trump on Monday, joining forces with the presumptive nominee. One, broadcasting executive Stanley Hubbard, previously donated to anti-Trump forces but said he was ready to get behind the mogul now. “All of my favorite candidates dropped out one by one. We’re down to my least favorite candidate. And my least favorite candidate is better than Hillary Clinton in terms of what’s best for the country,” Hubbard told (http://www.politico.com/blogs/2016-gop-primary-live-updates-and-results/2016/05/stanley-hubbard-donald-trump-great-america-pac-222981) Politico. And a major backer of Mitt Romney and Scott Walker, investment executive Anthony Scaramucci, told (https://www.washingtonpost.com/news/post-politics/wp/2016/05/09/anthony-scaramucci-a-top-republican-fundraiser-signs-on-with-trump-campaign/) The Washington Post he would join Trump's finance team. "I will do whatever I can to support our Republican nominee," he said.
** DOJ, North Carolina trade lawsuits over 'bathroom bill'
------------------------------------------------------------
The Justice Department on Monday filed a lawsuit against the state of North Carolina, claiming the state's so-called bathroom transgender law violated the Civil Rights Act and other laws that prohibit discrimination on the basis of sex. The filing landed only hours after North Carolina Gov. Pat McCrory made his own legal move, suing the Justice Department and asking a federal court to rule on whether the bill violates U.S. law. The act prohibits use of public bathrooms that do not match an individual's biological sex, as it is listed on their birth certificates. The lawsuits come after DOJ sent a letter last week telling McCrory: "Access to sex-segregated restrooms and other workplace facilities consistent with gender identity is a term, condition or privilege of employment. Denying such access to transgender individuals, whose gender identity is different from their gender assigned at birth, while affording it to similarly situated non-transgender employees, violates Title
VII." More on the suits here (http://www.cnn.com/2016/05/09/politics/north-carolina-hb2-justice-department-deadline?sr=nl_pol_050916_bathroombill) . Meanwhile, a new CNN/ORC Poll (http://www.cnn.com/2016/05/09/politics/poll-transgender-bathroom-law-north-carolina?sr=nl_pol_050916_bathroompoll) finds about 6 in 10 Americans oppose bills like the one in North Carolina.
