Rich B went over there to talk to the Site Manager. Rich also tells me that he believes that they have a permit to
do what they are doing. Rich also said that he got a letter from the construction manager asking for access to do
inspection and install monitoring devices. Rich said he will forward the letter to both of us. Please let me know
how you want me to proceed. Seems to me that this is definitely a nuisance and trespass issue, but if we say stop
digging and jack hammering then they will be unable to do what they are (according to Rich B) permitted to do.
Do you still want me to send a cease and desist letter? Please advise. Thanks.

Hi Darren I had a site meeting with Paul Livi ni who is the main project site manager for Merrick Real Estate Grou
,Construction Management His Cell # is The Merrick group address is
Merrick NY, 11566, and 95- Morton Street NY,NY 10014. Phone
Email Richard L Pesce is the head of the company. Today at 10:30 am Paul and i reviewed
the approved project blue prints showing the vast bedrock excavation that will take months to complete , the front &
back building design, and the under ground pool complex that will be 26' feet below street level that will be constructed
below the back yard which backs up to 9 East 71st street. He also stated he tried to do a piliminary construction
inspection of 9 East 71st street and was refused access . To move on from the past he would like to have sound monitor
and laser instruments put on 9 east to monitor sound and building movement during the chopping & drilling of the
bedrock and also to have an independent company come in to do an inspection and take pictures of the rear of the

property and inside back walls to check for any damage. Please call me to discuss the property inspection we may want
