Don't worry. We will not agree to any early termination on his community control. I have not even been advised of his
intent to seek early term. He was never required/ordered to be evaluated. A decision made by my predecessor — not
something I would have let slide. Will keep you posted if anything comes up.

Hi Barbara — We were just asked about our position on early termination of community control and/or transfer of
Mr. Epstein to regular probation. I obviously am not well versed in how your programs work. I was looking
over Chapter 948 and I was wondering whether Mr. Epstein was ever evaluated for treatment under 948.31, since
he was convicted of "exploitation of a child ... for prostitution." I know the statute was enacted after he pled
guilty, but it doesn't seem like there should be an Ex Post Facto issue since it isn't a punitive measure.
Do you know whether he has completed "the sanctions imposed in the community control plan"? I don't want to
give a position one way or the other if he isn't even eligible for modification or termination.
