[00:00:22] a what we called a transurrection. They
[00:00:24] unfurled banners. They um
[00:00:26] >> trans what?
[00:00:27] >> Transurction. Oh, trans surrection. I
[00:00:30] thought you said trans erection.
[00:00:31] >> No, no, that was a generation. That's a
[00:00:33] whole different issue.
[00:00:34] >> Okay. Transurrection continued.
[00:00:36] >> And uh so everybody was removed from the
[00:00:38] gallery. We couldn't debate the bill. Um
[00:00:41] the second time there was a point of
[00:00:43] order. It was very shortlived. And so
[00:00:45] the third time, you know, we were
[00:00:46] anticipating this would pass. We would
[00:00:48] be successful. uh myself and dozens of
[00:00:51] other activists um conservative
[00:00:54] activists were in the audience wearing
[00:00:56] matching red shirts and um that said
[00:00:59] save Texas kids. Uh during a lull we
[00:01:03] took a bathroom break. I escorted some
[00:01:05] of the older females I was carrying that
[00:01:08] day and we anticipated that there might
[00:01:10] be something um hinky happening and you
[00:01:13] know the that transurrection
[00:01:15] I'm trying to say it in a way that's not
[00:01:18] confusing. Um one of the activists the
[00:01:22] trans activists like hit my hand to try
[00:01:24] to take my phone away. They were
[00:01:25] screaming. They were berating us getting
[00:01:27] in our faces. So just to kind of add
[00:01:29] some protection I took them to the
[00:01:32] restroom. This man walks in, took who to
[00:01:35] the restroom.
[00:01:35] >> These ladies with me, the the other
[00:01:37] conservative activists, ladies.
[00:01:39] >> Um, while we're in line, a man walks in
[00:01:43] very clearly, a man, you know, besides
[00:01:45] the pink hair, nothing.
[00:01:47] >> That's the That's the individual in the
[00:01:49] photograph.

[00:01:51] >> Um, we allowed him to go before us, do
[00:01:54] his business. He came out, uh, was
[00:01:57] washing his hands. I held the door open
[00:02:00] to the whole restroom. So, what's
[00:02:03] notable is like in that situation,
[00:02:05] everybody can see inside that space.
[00:02:07] There's you can't see the stalls, but
[00:02:08] you can see who's lined up and who's
[00:02:10] drying their hands. So, um it's not
[00:02:12] really a private area. Uh as he was
[00:02:15] leaving, I said, "Please use the
[00:02:17] restroom across the hall next time. This
[00:02:19] is not a men's space." And he said,
[00:02:22] "Well, I'm legally a woman." Um
[00:02:25] go back to the gallery. A friend of mine
[00:02:27] says, "Hey, did you hear that they there
[00:02:29] was a man in the restroom?" I'm like, I
[00:02:30] said, "Yeah, I was in there." He said,
[00:02:32] "Well, so and so put it on Facebook." He
[00:02:35] sent me the picture. I did a a tweet
[00:02:38] about it, next post, and it just went
[00:02:41] viral really quickly, which had never
[00:02:43] happened to me before. So, it was a very
[00:02:45] odd experience to be happening in real
[00:02:47] time.
[00:02:48] >> Um, one and a half million views,
[00:02:50] tweeted 15, like retweeted 1500 times.
[00:02:54] Um, and people were making comments,
[00:02:57] trans activists were making comments
[00:02:58] like, "I'm going to report you to the
[00:03:00] DA, to DPS, tagging Capital DPS." And
[00:03:05] within a few hours, a DPS lieutenant,
[00:03:07] Department of Public Safety Lieutenant
[00:03:08] came over and took me aside and said,
[00:03:10] "Hey, we need to talk to you about
[00:03:11] this." Um, they took Go ahead.
[00:03:14] >> Sorry. Sorry. Finished.
[00:03:15] >> They took me to a a holding office and
[00:03:19] asked me about the photo. I said I
[00:03:21] didn't take it. And that's pretty much
[00:03:22] where the conversation ended.
[00:03:25] >> Did you tell the individual to take the
[00:03:27] photo? Did you participate in or did
[00:03:30] they just do it without you?
[00:03:32] >> They did it. I didn't know when as far
[00:03:34] as I know, that's settled constitutional
[00:03:36] law. Like if someone else takes a photo,
[00:03:38] you're allowed to publish it.
[00:03:39] >> Yeah. I mean, it's it's what they're
[00:03:41] trying to investigate me for is a state
[00:03:43] jail felony sex crime.

[00:03:52] photo of somebody in a private space
[00:03:55] without their consent
[00:03:58] with the intent of um sexualizing a
[00:04:02] photo in some way which clearly this was
[00:04:04] not some state law and pardon me I
[00:04:07] haven't looked into the particular law
[00:04:08] but it seems to me a matter of federal
[00:04:11] law there's a case called Bart Nikki
[00:04:13] voper which I know about because of the
[00:04:15] FBI rate against me with the Ashley
[00:04:16] Biden diary that if somebody else breaks
[00:04:18] the law even If even if the photographer
[00:04:21] broke the law, your publication of it
[00:04:24] shouldn't be illegal. That's that's what
[00:04:25] I know to be settled United States
[00:04:27] Supreme Court president.
[00:04:28] >> Well, and this man had already announced
[00:04:30] that he was a uh a candidate for Texas
[00:04:33] House. So, it's also in our mind
[00:04:36] political protected political speech
[00:04:38] because it's kind of a no no holds
[00:04:41] barred when it's a politician. You know,
[00:04:43] there's the I guess it was like Larry
[00:04:47] Flint. Mhm.
[00:04:49] >> Um used to do a lot of satire about
[00:04:51] public figures. So that kind of changes
[00:04:53] the game too. But um and plus it was
[00:04:57] retweeted by 1500 people. You know, I
[00:05:00] didn't take the photo. I published it.
[00:05:01] These people republished it by
[00:05:03] retweeting it. So including trans
[00:05:05] activists, but none of them are being
[00:05:07] pursued.

[00:05:11] where someone took a photograph in a
[00:05:14] bathroom of a transgender individual?
[00:05:17] Um, the only one that I'm aware of is
[00:05:20] Payton McNab, who is a female athlete.
[00:05:22] Um, in her college
[00:05:26] uh, bathroom, there was a man dressed as
[00:05:29] a woman. She took video of that person
[00:05:31] and told them to leave essentially. And
[00:05:34] I think she was removed from her
[00:05:35] sorority. She was threatened with
[00:05:38] expulsion. Um, but nothing happened to
[00:05:40] the man.
[00:05:41] >> No, no criminal actions. So, there's a
[00:05:44] lot to unpack here. In no particular
[00:05:46] order, the officer that confronted you,
[00:05:49] do you think he was just doing your job
[00:05:50] or do you think he agreed with the
[00:05:52] transgender movement activities?

[00:05:56] spoken with him subsequently and he's I
[00:05:59] wouldn't say that he's supportive, but
[00:06:00] he's been very communicative.

[00:06:12] got its way into federal court. Is that

[00:06:43] in December 9th, in a two-1 opinion, the
[00:06:45] Fifth Circuit said, "No need to pause.
[00:06:47] Move forward." Um, this is

[00:08:01] biological reality, like you do not
[00:08:03] belong here. Please don't be in this
[00:08:06] space. Um, what's interesting is a
[00:08:09] couple of things have changed since May
[00:08:11] of 2023. This statute has changed where
[00:08:15] anybody who is convicted of this
[00:08:18] particular crime has to register as a
[00:08:21] sex offender. So, yeah.
[00:08:25] You know, I I in the weeks after this
[00:08:27] happened, my biggest fear was, do I am I
[00:08:30] going to be convicted and have to
[00:08:32] register as a sex offender, maybe lose
[00:08:34] my children as a result of that?

[00:08:40] >> Um, there has been no indictment that
[00:08:42] I'm aware of. I check the the warrant
[00:08:45] search database a few times a week to
[00:08:47] see if he's filed a warrant against me,
[00:08:49] and nothing has been filed so far.

[00:08:52] statute of limitations expire? dismay.
