Senate Judiciary GOP Urge President Biden Not To End Title 42

American people particularly people in [00:12:48] Mexico [00:12:49] and Texas [00:12:51] what's going to happen is that the bide [00:12:53] Administration is going to repeal the [00:12:55] use of title 42 authority to to expel [00:12:59] people this is not deportation this is [00:13:02] expelling It's the ability to tell [00:13:05] somebody you have to go back home [00:13:06] because of title 42 concerns that goes [00:13:09] away on May the 11th so what comes where [00:13:13] are we [00:13:17] in the past 90 days [00:13:19] there have been [00:13:21] 566 [00:13:23] 163 uh border encounters with illegal [00:13:27] immigrants 6 300 a day [00:13:31] where are we headed [00:13:32] here's the estimates if you repeal title [00:13:35] 42 there will be a surge and here's what [00:13:39] DHS says it goes from 6 300 a day to 10 [00:13:43] to 13 000 a day so in the next 90 days [00:13:46] you're going to be from 900 000 to 1.1 [00:13:50] million that's what's coming [00:13:52] if you repeal title 42 on May the 11th [00:13:56] you're basically doubling [00:13:58] the problem [00:14:05] it's just not Republicans concerned [00:14:07] about this [00:14:08] uh [00:14:10] these are news outlets reporting what is [00:14:13] to come after May 11th every news [00:14:16] organization in the country pretty much [00:14:18] sees this the same that there's going to [00:14:21] be a dramatic increase in illegal [00:14:24] Crossings because people are sitting in [00:14:26] Mexico waiting to May 11th they're [00:14:29] amassing by the thousands knowing that [00:14:31] when May 11th comes it's much easier to [00:14:34] come into the country and not get [00:14:35] expelled [00:14:43] these are democratic mayors [00:14:46] are saying we're overwhelmed this is [00:14:49] just not a Republican party these are [00:14:51] mayors of Washington Chicago New York [00:14:55] begging the my the body Administration [00:14:57] to change course and change policy this [00:15:00] is affecting the entire country not just [00:15:03] border states [00:15:07] but if you're in Texas [00:15:10] you're on the tip of the spear [00:15:12] Brownsville Laredo and El Paso have [00:15:15] declared states of emergency because [00:15:18] they know what's coming May the 11th [00:15:21] these cities are being overrun [00:15:24] they're having more capacity than they [00:15:27] can handle crime is up disruption in [00:15:31] these cities are just is just really out [00:15:33] of control I'll turn it over to John [00:15:35] here in a second he can talk better [00:15:37] about Texas but to the Biden [00:15:39] Administration what the hell has to [00:15:40] happen for you to change policy at what [00:15:43] point are you going to take this [00:15:44] seriously at what point are you going to beg and plead with this [00:16:01] Administration I've asked Democrats to [00:16:04] join the effort to not repeal title 42 [00:16:07] May the 11th it's been used 2.3 million [00:16:11] times [00:16:12] to expel people who came here illegally [00:16:15] that Authority goes away next week so [00:16:18] it's not like it doesn't matter it's [00:16:20] been used by the administration probably [00:16:22] more than any tool in the toolbox and [00:16:25] they're taking out of the toolbox one of [00:16:27] the most effective tools they have to [00:16:30] deter illegal immigration and come next [00:16:33] week all hell is going to break loose [00:16:35] along the border and eventually we flow [00:16:38] into the interior of the United States [00:16:41] about solving illegal immigration [00:16:44] John and I have set down with democrats [00:16:46] for over a decade now trying to fix this [00:16:48] problem [00:16:49] this is a self-inflicted wound by the [00:16:51] body Administration they have the power [00:16:53] to continue this policy they have the [00:16:56] power by executive action to keep people [00:16:58] out of the country when they when they [00:17:01] want to claim Asylum they repeal the [00:17:04] Trump policies that led to the lowest [00:17:07] illegal Crossings in December of 2020 in [00:17:10] recent history it was a choice they made [00:17:12] this has got nothing to do with Congress [00:17:15] acting or not acting this is a conscious [00:17:18] decision by the Biden Administration to [00:17:20] take a tool out of the toolbox that's [00:17:22] been very effective and it's going to [00:17:24] lead to holy hell it's going to lead to [00:17:27] just a crushing of the border cities [00:17:29] that are already Under Siege and [00:17:32] Democratic Mayors are begging to buy an [00:17:34] Administration to change course we're [00:17:36] begging them to change course and I am [00:17:39] hoping that our message will get through [00:17:41] but time will tell Senator cornyn knows [00:17:44] this as well as anybody better than most [00:17:48] well I appreciate my friend Senator [00:17:50] Graham for uh arranging this press [00:17:52] conference he's exactly right [00:17:55] what is what is currently a flood of [00:17:57] humanity [00:17:59] coming across the border is getting [00:18:00] ready to become a tsunami [00:18:03] and it because the tool that the Biden [00:18:05] Administration has used title 42 the [00:18:08] pandemic law the public health law is [00:18:10] going to expire [00:18:11] and unless they put something else in [00:18:14] its place to to plug that hole you're [00:18:16] going to continue to see more and more [00:18:18] people encouraged by the prospect of [00:18:20] being able to successfully make it [00:18:22] across the border into the interior of [00:18:25] the United States [00:18:27] it is [00:18:29] astonishing to me [00:18:31] how many people in the bite [00:18:32] Administration will lie about the [00:18:35] severity of this problem who will try to [00:18:37] downplay it like secretary mayorkas who [00:18:40] said the the border is secure well if [00:18:42] the board is secure why is President [00:18:43] Biden 1500 active duty military down to [00:18:46] the Border [00:18:48] when they can't enforce immigration law [00:18:49] all they can do is change diapers and [00:18:53] push paper [00:18:54] in other words under the law they can [00:18:56] only perform administrative functions [00:18:59] but this This Disaster has so many [00:19:02] different uh [00:19:03] effects just think for a minute about [00:19:06] the 1.2 million gotaways [00:19:09] people that did not turn them in and [00:19:11] claim Asylum if you claim Asylum you're [00:19:13] going to be allowed to go to the [00:19:14] interior of the country perhaps never to [00:19:16] be heard from again so that's reason [00:19:19] people keep coming and and saying the [00:19:22] words they know they need to say that [00:19:24] they've been coached to say to be able [00:19:26] to successfully make their way into the [00:19:28] interior of the country some places like [00:19:29] New York it's a 10-year wait [00:19:31] before you can even begin immigration [00:19:34] proceedings in front of an immigration [00:19:36] judge [00:19:37] and then there's the drugs [00:19:40] 108 000 roughly American citizens died [00:19:43] of drug overdoses last year 71 000 of [00:19:47] those fentanyl I was in Carrollton [00:19:49] Farmers Branch at a high school last [00:19:52] week listening to parents who who were [00:19:56] saying you know my child thought they [00:19:58] were taking [00:19:59] something like a percocet or a Xanax [00:20:01] only to find out if it was a it was [00:20:04] contaminated with with fentanyl [00:20:07] basically a pencil lead the tip of a [00:20:10] pencil a volume of fentanyl will take [00:20:12] your life that's why the Drug [00:20:15] Enforcement Administration others are [00:20:17] are trying to socialize the idea that [00:20:19] one pill can kill [00:20:21] and then the last thing I'll mention [00:20:24] is the unaccompanied children [00:20:26] because of the way that unaccompanied [00:20:28] children are treated under our system [00:20:30] effectively placed with sponsors in the [00:20:33] interior of the United States we know [00:20:35] for a fact that Health and Human [00:20:36] Services that is in charge of that has [00:20:39] lost touch with tens of thousands of [00:20:42] minor children [00:20:45] we're supposed to be protecting their [00:20:47] safety we're supposed to be looking [00:20:49] after them but the New York Times for [00:20:51] example has run a couple of [00:20:52] investigative stories pointing out that [00:20:54] many of these children are being put [00:20:57] into forced labor [00:20:58] in violation of our child labor laws [00:21:02] who knows how many of these children [00:21:03] that the Biden Administration has lost [00:21:06] are in abusive [00:21:09] family situations been sexually [00:21:12] assaulted recruited into gangs [00:21:15] all of this comes down to the Biden [00:21:17] border crisis and the Biden [00:21:19] administration's conscious decision not [00:21:21] to enforce current laws and refusing to [00:21:25] work with reasonable people [00:21:28] to try to come up with Solutions [00:21:31] about a year maybe you know two years [00:21:33] ago now Senator Cinema and I and Tony [00:21:36] Gonzalez and Henry Cuellar introduced [00:21:38] the bipartisan border Solutions act [00:21:40] another bill that we thought that if [00:21:43] this got bad enough that the blight [00:21:45] Administration like a drowning person [00:21:47] would look for a Lifeline to grab a hold [00:21:50] of and we wanted to provide them with a [00:21:53] bipartisan bicameral Bill to begin that [00:21:55] discussion [00:21:56] but they refused even that [00:21:59] so I appreciate Senator Graham taking [00:22:02] the lead on this issue this is a bad [00:22:05] situation that's about to get much much [00:22:09] worse [00:22:10] and the answer is not 1500 active duty [00:22:13] service members [00:22:15] they didn't join the military they go to [00:22:17] the border and push paper and change [00:22:19] diapers [00:22:20] but under the law that's all they can do [00:22:22] is perform administrative functions they [00:22:24] can't actually even enforce the [00:22:26] immigration law [00:22:27] so this is a symbolic move that has zero [00:22:32] meaning when it comes to changing the [00:22:34] Status Quo and we're here to say if you [00:22:38] think things are bad now [00:22:40] they're going to get worse come May the [00:22:42] 11th what is [00:23:08] this morning incoming Chicago mayor [00:23:10] Brandon Johnson to cry what he said are [00:23:12] governors of the board that are not [00:23:14] willing to collaborate when it comes the [00:23:16] migrant issue and [00:23:17] the governor's like Governor Abbott has [00:23:20] done migrants in cities like Chicago [00:23:21] what's your reaction [00:23:24] well I don't I would ask the question [00:23:26] what are the governors of border states [00:23:28] like Texas supposed to do [00:23:30] and these border communities are being [00:23:32] overwhelmed [00:23:34] um [00:23:35] I think Governor Abbott and Governor [00:23:38] DeSantis and others who have blessed [00:23:42] migrants that basically facilitated [00:23:43] their their [00:23:46] travel to some of these cities like new [00:23:48] New York Washington and Chicago they've [00:23:51] done so in desperation trying to gain [00:23:55] the president's attention thinking well [00:23:57] he won't listen to Republicans maybe [00:24:00] he'll listen to Democrats and maybe [00:24:02] he'll listen to these mayors of these [00:24:04] large cities [00:24:06] Senator Graham and I were just having [00:24:08] the conversation we are just completely [00:24:11] baffled [00:24:13] about what it will take to get the Biden [00:24:15] administration's attention if it's not [00:24:17] the death of 108 000 Americans due to [00:24:20] drug overdoses if it's not forced labor [00:24:22] for unaccompanied children placed in the [00:24:24] interior if it's not people women [00:24:28] and girls getting sexually assaulted in [00:24:30] the travel from their home country into [00:24:33] the United States in the Tinder in the [00:24:36] tender care of the the cartels and [00:24:38] transnational criminal organizations [00:24:39] what will it take to get Joe Biden's [00:24:42] attention [00:24:43] we're just completely [00:24:45] bamboozled by [00:24:49] their lack of attention to this and [00:24:50] maybe that will be something that will [00:24:52] get somebody's attention someday they [00:24:54] run out of enough room then maybe Joe [00:24:57] Biden they'll pick up the Fallen call [00:25:00] same [00:25:19] Authority title 42 has or something yeah [00:25:22] I'm asking them to find a acceptable [00:25:24] substitute for title 42. this is like [00:25:28] being hit by a slow-moving truck in [00:25:30] Kansas [00:25:32] this has been going on for like a year [00:25:35] here we are next week and they have no [00:25:38] adequate substitute so you're going to [00:25:40] take off the table a tool that allows [00:25:43] expelling 2.3 million illegal immigrants [00:25:46] under title 42 you don't have an [00:25:48] adequate substitute that's the point in [00:25:52] the coveted emergency ends but there's [00:25:54] things you can do Trump did [00:25:57] that like they're helpless they're not [00:25:59] they've repealed policies at work [00:26:01] because the left has forced them to make [00:26:03] political decisions on the border that's [00:26:06] putting our country at risk the quality [00:26:08] of life along the border communities in [00:26:11] this country is being destroyed [00:26:13] and interior Governors complain about [00:26:16] reducing the quality life of their [00:26:18] states what is Texas and these other [00:26:21] states [00:26:22] what are they going to do so yeah our [00:26:24] plea is [00:26:26] do something that gives you the ability [00:26:28] to continue to deter illegal immigration [00:26:31] just repealing title 42 without an [00:26:34] adequate substitutes makes the problem [00:26:36] worse one of the things one of the [00:26:38] things that that President Biden could [00:26:41] do is use a law that was signed by [00:26:44] President Clinton [00:26:45] to provide for expedited removal of [00:26:49] course that doesn't fix the broken [00:26:50] Asylum system which is another big [00:26:52] component of this but it would provide [00:26:54] that adequate substitute that Senator [00:26:57] Graham has [00:26:58] has mentioned but I think none of us [00:27:00] have any confidence in the by [00:27:02] demonstration's commitment to enforce [00:27:04] the immigration laws and to prevent This [00:27:06] Disaster from getting even worse [00:27:10] foreign [00:27:11] and Kamala Harris have presided over the [00:27:14] worst disaster in our Southern Border in [00:27:16] our nation's history [00:27:19] this was not an accident [00:27:20] it was deliberate [00:27:22] it was the consequence of deliberate [00:27:25] political decisions [00:27:27] that have created this chaos [00:27:30] this crisis was caused by three [00:27:32] political decisions made in the very [00:27:33] first week of the presidency number one [00:27:35] Joe Biden immediately halted [00:27:37] construction of the border wall [00:27:39] number two Biden reinstated the [00:27:42] disastrous policy of cat catch and [00:27:44] release [00:27:45] and number three Biden pulled out of the [00:27:50] incredibly successful remain in Mexico [00:27:52] agreement [00:27:54] the consequence of those political [00:27:56] decisions was catastrophic [00:27:58] we went from the lowest rate of illegal [00:28:00] immigration in 45 years which is what [00:28:03] Joe Biden inherited what we had in 2020 [00:28:05] under Donald Trump's success [00:28:09] and Biden and Harris came in and turned [00:28:11] success into failure not just failure [00:28:14] abysmal failure they didn't just go back [00:28:17] to Obama level [00:28:41] and we saw just this week in Texas [00:28:45] the horrific consequences [00:28:47] a mass murderer who In Cold Blood [00:28:51] assassinated five people assassinated a [00:28:54] family including an eight-year-old child [00:28:58] we now know that mass murderer was an [00:29:00] illegal alien [00:29:02] who had repeatedly entered the country [00:29:04] illegally who had been repeatedly [00:29:05] deported [00:29:07] and yet [00:29:10] because under Joe Biden's open border [00:29:12] policy ice is prevented [00:29:15] from deporting dangerous dangerous [00:29:17] illegal the border illegally last [00:30:23] year he said I don't know I have no idea [00:30:25] remember that the next time he tells you [00:30:28] how compassionate he is [00:30:30] he doesn't even bother to know [00:30:33] how many people his policies are killing [00:30:35] the answer is 853. [00:30:37] I can tell you when we were down there [00:30:39] John and I together brought 19 Senators [00:30:41] down to the Border we were out on the [00:30:43] Rio Grande we saw a dead body a man [00:30:45] floating in the water who had drowned [00:30:48] Crossing illegally [00:30:52] I've seen women [00:30:55] who've been violently raped by the [00:30:57] cartels [00:30:59] I've seen children [00:32:48] dynamic I think what Senator Cruz said [00:32:50] is [00:32:51] it comes a point in time this is really [00:32:53] deliberate sixty thousand people have [00:32:56] been granted parole under this [00:32:57] Administration that's a process under [00:32:59] U.S law this made meant to be used [00:33:01] judiciously where you have a review [00:33:04] there's a certain situation that would [00:33:07] allow the person that got up here in [00:33:09] court they got a family member dying I [00:33:12] think during the uh the uh Trump years [00:33:14] maybe 10 or 12 people granted parole [00:33:16] sixty thousand so what am I going to do [00:33:19] next [00:33:20] with these gentlemen from Texas senators [00:33:22] were explaining to the country that next [00:33:25] week's going to be a bad week and you [00:33:26] could avoid it if you chose to the 1500 [00:33:29] soldiers are not going to do a damn [00:33:30] thing but I intend to disclose and [00:33:33] uncover I think a conscious abuse of the [00:33:36] law to allow people in through a process [00:33:40] that I don't think the law ever intended [00:33:42] so I think exhibit a is to whether or [00:33:46] not this illegal Crossings in December of 2020 as [00:34:29] Senator crew said in 45 years so I would [00:34:32] suggest that if you want to compare the [00:34:34] Trump performance on the border to Biden [00:34:37] it's an easy comparison to make what am [00:34:39] I urging the body Administration do [00:34:41] because Trump did it doesn't mean you [00:34:43] can't do it your country is being important part of how you secure the [00:35:47] Border [00:35:48] however under Joe Biden the 1500 troops [00:35:51] he's sending [00:35:53] we'll accomplish nothing to secure the [00:35:54] border and they're not designed to and [00:35:56] here's why [00:35:57] the troops on the border are beneficial [00:36:00] if you have a policy that when you [00:36:02] apprehend someone [00:36:03] you Deport them [00:36:05] then the troops on the border are [00:36:07] helpful for apprehending people coming [00:36:08] across [00:36:10] as long as the Biden Administration [00:36:12] keeps in place catch and release [00:36:15] he could send 1500 troops he could send [00:36:17] ten thousand troops he could send a [00:36:19] hundred thousand troops [00:36:20] it would do nothing to secure the Border [00:36:23] why because every illegal immigrant they [00:36:25] encounter [00:36:26] they would hand over to the Biden [00:36:28] Administration and the Biden [00:36:29] Administration would let them go [00:36:31] actually more than let them go would put [00:36:33] them on a plane or put them on a bus [00:36:36] and take them to whatever city in [00:36:38] America they want to go to Joe Biden mayorcas's testimony before [00:36:51] the Senate Judiciary Committee which all [00:36:53] three of us vigorously questioned him at [00:36:56] the time [00:36:57] and there was one moment in that [00:36:58] questioning when I put up a poster board [00:37:00] and it had a series of pictures of [00:37:02] colored wristbands [00:37:04] and I asked him I said Mr secretary what [00:37:06] are these colored wristbands [00:37:08] and his answer he said I I don't know I [00:37:10] have no idea [00:37:12] I I gotta admit that answer actually [00:37:14] surprised me very little he said in that [00:37:16] hearing surprised me that answer [00:37:18] astonished me [00:37:21] and my response to him I said Mr [00:37:22] secretary you have just told the [00:37:24] American people that you were utterly [00:37:26] incompetent at your job and you do not [00:37:28] even care about doing it why [00:37:32] because just about every illegal [00:37:33] immigrant who crosses the Border [00:37:36] has know work were repealed for a [00:40:34] political reason [00:40:35] title 42 ends May the 11th and we are [00:40:39] here begging the administration it is in [00:40:42] your power to adequately substitute [00:40:44] title 42 Authority you've done nothing [00:40:48] from my point of view and Ted knows this [00:40:50] better than anybody to provide an [00:40:52] adequate substitute so the reason 10 000 [00:40:56] people in one city have gathered waiting [00:40:58] for May the 12th is because they don't [00:41:01] see an adequate substitute [00:41:03] people voting with their feet on the [00:41:06] ground tell you they don't see anything [00:41:08] replacing title 42 they're concerned [00:41:11] about these surges would not be existing [00:41:13] if they had found a way to replace title [00:41:16] 42 and communicate it to people you're [00:41:19] wasting your time and your money so the [00:41:21] fact that the surge is coming tells me [00:41:23] they have made no corrective
