[00:00:00] Uh, thank you very much. Thank you for [00:00:01] the hearing. Number one, an observation. [00:00:03] If the shoe were on the other foot, it'd [00:00:05] be front page news all over the world [00:00:07] that Republicans went after sitting [00:00:10] Democratic senators phone records. Uh, [00:00:14] it'd be news all over the world that 490 [00:00:18] Democratic or 30 Democratic [00:00:20] organizations had 197 subpoenas issued [00:00:24] by some right-wing prosecutor. [00:00:26] And the cavalier attitude that some of [00:00:28] you have, well, you know, nothing really [00:00:30] bad here happened. I disagree. [00:00:33] Fundamentally disagree. And if you ever [00:00:36] had a doubt about where the media is at [00:00:38] and where our friends on the other side [00:00:39] of that, this should bring us all [00:00:41] together. Apparently, it will not. So, I [00:00:43] just want to let you know, uh, I don't [00:00:45] think I deserve what happened to me. Uh, [00:00:48] Mr. Schwagger, were you there on six, [00:00:50] January 6th? [00:00:51] >> Uh, I was with you all, sir. [00:00:53] >> Yeah. Did you hear my floor speech? Uh I [00:00:56] don't recall who's in the chamber [00:00:58] because I said let's end this thing. [00:01:00] >> So uh to Verizon, you had a contract [00:01:04] with the Senate. Is that correct? [00:01:06] >> That's correct, Senator. [00:01:07] >> And that was in 2022. [00:01:10] >> We've had a contract with the Senate for [00:01:11] communication services. [00:01:12] >> Okay. Well, the last one that I saw was [00:01:14] 2022. Uh how much money was that [00:01:17] contract worth? [00:01:18] >> I don't know, Senator. [00:01:19] >> Would you say tens of millions of [00:01:21] dollars? [00:01:22] >> It it could be, Senator. I just don't. [00:01:23] >> Okay. That contract was had a clause in [00:01:26] it that if anybody comes after a [00:01:28] senator's phone records, you will tell [00:01:30] us so we can to defend oursel. Was that [00:01:32] a contract obligation? [00:01:34] >> Senator, I'm aware of the [00:01:36] >> It was. It was. [00:01:39] So, this is what you sent Jack Smith [00:01:43] about my official. He He has my official [00:01:46] account. It says United States Senate [00:01:50] Sergeant-at-Arms account. So you should [00:01:53] have been alerted that this was the [00:01:56] sergeant- of- arms. You have a contract [00:01:58] obligation [00:01:59] to the sergeant-at-arms and to me [00:02:01] through that. The other one is my [00:02:04] campaign phone. My personal my campaign [00:02:08] phone and my official. [00:02:10] This is team Graham. [00:02:15] Anyway, [00:02:18] at the time of 2023, when they made this [00:02:22] request about information regarding Team [00:02:26] Graham and my official phone records, [00:02:30] you were unable to find out that it was [00:02:32] me. [00:02:34] Is that your testimony? You didn't know [00:02:36] it involved me, [00:02:38] >> Senator. The analyst responding to that [00:02:41] subpoena, [00:02:42] >> did they know it was me? Is that fair to [00:02:44] say? I I do not know, sir. [00:02:46] >> Well, so you need to answer that because [00:02:49] you got a contract to protect us [00:02:54] and you don't have anything in place to [00:02:56] find out if we're being asked by the [00:02:59] executive branch. You got all that money [00:03:03] and you did nothing to earn that money [00:03:06] because would you agree the system [00:03:09] failed me because I wasn't notified and [00:03:11] you gave my information to the special [00:03:13] counsel? [00:03:14] >> Senator, I would certainly agree we have [00:03:17] frustrated you as a policy maker. [00:03:19] >> You failed me. You failed to honor the [00:03:21] contract protecting all of us. Do you [00:03:24] you realize section 2 USC 6628 says [00:03:30] a Senate office shall not be barred [00:03:32] through operation of any court order or [00:03:34] any statutory provision from notifying [00:03:36] the Senate of any legal process. Mr. [00:03:39] McKe Mc [00:03:40] >> Mcate [00:03:41] >> McIT sir [00:03:43] >> you were familiar with that right? [00:03:45] >> Yes sir. Yes sir. [00:03:46] >> And when you found out it was Senator [00:03:47] Cruz you went to bat for Senator Cruz. [00:03:50] We asked that question. I testified too [00:03:52] early. [00:03:52] >> And they backed down and folded like a [00:03:54] cheap suit. They never pushed. They [00:03:56] never wanted to court. Right. [00:03:58] >> They never followed up. [00:03:59] >> Yeah. Because they're on a fishing [00:04:00] expedition. So if any of you had [00:04:02] challenged these guys, they'd went away. [00:04:04] So the Senate gave you probably tens of [00:04:06] millions of dollars and I've been a [00:04:08] customer for a very long time. What [00:04:11] about the 430 Republican groups? What [00:04:15] about the 197 subpoenas? We're not going [00:04:18] to give up on this. This is a major [00:04:23] breakdown of constitutional checks and [00:04:25] balances, a major breakdown of [00:04:28] protecting people, you have a [00:04:30] contractual obligation to protect and I [00:04:32] think the biggest weaponization of the [00:04:34] law. But that is yet to be determined. [00:04:36] So here's what I want you to know. If [00:04:38] you contract for a service, you need to [00:04:40] provide that service. And if you can't [00:04:43] provide it, you let your customer down. [00:04:46] The system [00:04:48] gave you all the discretion you needed [00:04:52] and you didn't use it. And if you had [00:04:55] used it, AT&T tells you what you got. [00:04:57] How much more information you need to [00:04:59] know about me when it says team Graham, [00:05:02] Senate Sergeant-at-Arms. And finally to [00:05:04] this subpoena, the subpoena language. [00:05:09] This is beyond offensive. [00:05:13] Mr. Miller, do I have control of eight [00:05:14] of Verizon records? [00:05:18] >> Senator, [00:05:18] >> are they in my control? [00:05:19] >> Senator, at that time, we had a [00:05:21] different view of the statuto. The [00:05:23] >> answer is no. I don't have my own [00:05:25] records. You have it. How am I going to [00:05:26] tamper with evidence I don't have. This [00:05:29] finding is offensive. What happened [00:05:33] shall never happen again. And the only [00:05:35] way we're ever going to get to the [00:05:36] bottom of it is hold people accountable [00:05:38] to fulfill their contractual obligations [00:05:41] and use common sense to protect a [00:05:43] republic that depends on separation of [00:05:46] powers which was obliterated here. Thank [00:05:48] you.
