[00:00:01] prosecutor's attempt to criminally
[00:00:02] charge Don Lemon in relation to his
[00:00:04] presence this week during a protest at
[00:00:05] that St. Paul church. One of the people
[00:00:07] arrested as mentioned was Nikima Levy
[00:00:10] Armstrong, a civil rights attorney. And
[00:00:12] here she was on CNN claiming that she
[00:00:14] was welcomed into the church. Well, I
[00:00:16] mean under false opies as she then
[00:00:18] proceeds to explain.
[00:00:20] >> We did [snorts] not rush into that
[00:00:21] church. We actually went and sat down
[00:00:24] and participated in the service. And
[00:00:26] after the pastor prayed, that is when I
[00:00:29] stood up and asked him a question in
[00:00:32] response to his prayer. And then I and
[00:00:35] he responded to me. And then I proceeded
[00:00:38] to ask him about Pastor David Easterwood
[00:00:41] and how is it possible for him to serve
[00:00:43] as both the pastor and the director of
[00:00:46] ICE for Minnesota. And instead of
[00:00:48] responding to me, as soon as I said the
[00:00:51] name David Easterwood, the pastor says,
[00:00:54] "Shame,
[00:00:55] shame." And that is when I led us in
[00:00:59] chance justice for Renee, good and hands
[00:01:01] up, don't shoot.
[00:01:02] >> That of course is ridiculous. You don't
[00:01:03] get to go into somebody else's church
[00:01:05] and then if you wait for 5 minutes and
[00:01:07] then break out into a disruption of the
[00:01:09] church service,
[00:01:11] call that permission to enter the
[00:01:13] church. That is not that is not right.
[00:01:15] If you go into somebody's house claiming
[00:01:17] that you are, for example, a carpet
[00:01:18] salesperson and you want to check out
[00:01:19] the house and the person invites you in,
[00:01:21] you proceed to steal all the crockery.
[00:01:23] Well, it turns out they didn't invite
[00:01:24] you in the house to steal the crockery.
[00:01:26] That is a that is a ridiculous argument
[00:01:27] and that is one is not going to hold up
[00:01:29] in court. Now, one of the people that
[00:01:31] the DOJ wanted to charge was Don Lemon,
[00:01:33] the former CNN talking head and host.
[00:01:37] So, Don Lemon, and again, I know Don.
[00:01:40] Don is a um he is a a a character to say
[00:01:45] the very least. Well, Don had pretty
[00:01:47] clearly allegedly allegedly coordinated
[00:01:50] with this group to be there. How else
[00:01:51] would he know to be there? He wasn't
[00:01:52] just attending a random church in St.
[00:01:54] Paul on that day. That is not what was
[00:01:56] happening. Well, he showed up and a
[00:02:00] judge in Minnesota was handed an
[00:02:04] indictment for him and rejected the
[00:02:06] indictment. That judge rejected the
[00:02:09] federal prosecutor's attempt to
[00:02:10] criminally charge Don Lemon in relation
[00:02:12] to his presence this week during a
[00:02:13] protest at that St. Paul Church.
[00:02:15] According to the Washington Post, this
[00:02:16] represents an extraordinary rebuke of a
[00:02:18] justice department that has drawn
[00:02:20] criticism for its forceful response to
[00:02:22] demonstrations against ICE offers
[00:02:24] officers.
[00:02:26] The magistrate judge's decision was
[00:02:27] described at Thursday by two people
[00:02:28] familiar with the matter who spoke on
[00:02:30] the condition of anonymity. Their
[00:02:32] accounts emerged the same day department
[00:02:33] officials announced the arrest of again
[00:02:35] the other three. Well, it turns out,
[00:02:38] shock of shocks, it turns out that the
[00:02:40] judge in this particular case, according
[00:02:42] to Bill Malugan of Fox News, his wife
[00:02:45] works as an assistant attorney general
[00:02:46] in Minnesota under Keith Ellison. So
[00:02:50] Keith Ellison is the attorney general of
[00:02:52] the state and he of course is an ally of
[00:02:53] Don Lemon. In fact, here he was over the
[00:02:55] course of the last 24 hours joining Don
[00:02:57] Lemon's show to explain why Don Lemon
[00:03:00] didn't do anything wrong.
[00:03:01] >> This is I mean, look, it's a it's a w
[00:03:03] it's a wild stretch and inappropriate.
[00:03:05] And the and the and the face act, by the
[00:03:07] way, is designed to protect the rights
[00:03:10] of people seeking their reproductive
[00:03:12] rights to be protected. uh and so that
[00:03:15] people for a religious reason uh you
[00:03:18] know cannot just use religion to break
[00:03:20] into women's reproductive health
[00:03:23] centers. Right? So how they are
[00:03:26] stretching either of these laws to apply
[00:03:28] to people who protested in a church over
[00:03:31] the behavior or the perceived behavior
[00:03:33] of a of a of a religious leader is is
[00:03:35] beyond me. Um but they don't mind
[00:03:38] stretching these days.
[00:03:39] >> Okay. Well, it's not actually a stretch.
[00:03:41] Now, Keith Ellison is out there telling
[00:03:43] Don Lemon, quote, "People have a right
[00:03:44] to lift up their voices and make their
[00:03:45] peace, and none of us are immune from
[00:03:47] the voice of the public." And then he
[00:03:49] said, "Chanting cannot be a crime. It's
[00:03:51] freedom of expression." Well, actually,
[00:03:54] not so much. Not so much. It turns out
[00:03:56] that the Face Act explicitly talks about
[00:04:00] the attempts to disrupt church services.
[00:04:04] It explicitly protects religious
[00:04:06] freedom. It imposes criminal penalties
[00:04:08] on anyone who quote by force or threat
[00:04:10] of force or by physical obstruction
[00:04:11] intentionally injures, intimidates, or
[00:04:13] interferes with or attempts to injure,
[00:04:15] intimidate, or interfere with any person
[00:04:16] lawfully exercising or seeking to
[00:04:18] exercise the First Amendment right of
[00:04:20] religious worship at a place of
[00:04:22] religious worship.
[00:04:24] That is what it is. That's legitimately
[00:04:26] what the law was designed to do. Why?
[00:04:28] Well, because it was essentially a
[00:04:29] trade. This was a bipartisan bill signed
[00:04:32] into law in 1994.
[00:04:34] On the one hand, Democrats were saying
[00:04:35] that they wanted to protect abortion
[00:04:37] clinics from people who are obstructing
[00:04:38] the entrances, and Republicans said,
[00:04:39] "We're not going to vote for that unless
[00:04:41] you also vote that you're not allowed to
[00:04:43] disrupt church services." So, yes, part
[00:04:44] of the FACE act is preventing this sort
[00:04:46] of stuff pretty clearly.
[00:04:50] But that's what Keith Ellison is all
[00:04:51] about. Again, it is not about the
[00:04:54] impartial administration of law. And so
[00:04:57] there's something a little bit
[00:04:59] problematic about the fact that the wife
[00:05:01] of the judge who's protecting Don Lemon
[00:05:04] works for Keith Ellison. Representative
[00:05:07] Tom Emmer, he says Keith Ellison needs
[00:05:09] refresher course in law. This is true.
[00:05:13] >> But there's another thing he said which
[00:05:14] is this behavior did not violate the
[00:05:17] First Amendment. This is what they do.
[00:05:18] They just go to talking points.
[00:05:21] Keith Ellison is a is a lawyer. Uh he's
[00:05:24] our attorney general. He's an
[00:05:25] embarrassment. uh he would pre prefer to
[00:05:27] prosecute cops uh and defend criminals
[00:05:30] rather than doing his job. And by the
[00:05:32] way, when you suggest that interrupting
[00:05:34] a faith community during while they're
[00:05:37] worshiping is a exercise of your first
[00:05:40] amendment rights, I would suggest he
[00:05:41] head back for a refresher course in law
[00:05:43] school cuz he clearly didn't learn the
[00:05:45] law cuz he certainly doesn't understand.

[00:07:05] coverage is leading to significant and
[00:07:07] rage in places like Minneapolis. It is
[00:07:09] ratcheting up the tensions with ICE.
[00:07:11] Again, the vice president was visiting
[00:07:12] at Minneapolis and he said, "Listen, the
[00:07:14] problem here is Minneapolis authorities,
[00:07:16] not ICE."
[00:07:18] But the number one way where we could
[00:07:20] lower the mistakes that are happening,
[00:07:22] at least with our immigration
[00:07:23] enforcement, is to have local
[00:07:25] jurisdictions that are cooperating with
[00:07:26] us. There are some very basic things
[00:07:29] that would make Minneapolis look like
[00:07:32] look Memphis, Tennessee, a blue city
[00:07:34] where you do not have this chaos in
[00:07:36] immigration enforcement because the
[00:07:38] local police and the local authorities
[00:07:40] are cooperating with us. So when you
[00:07:42] look at Memphis, Tennessee or Austin,
[00:07:44] Texas, or any other community virtually
[00:07:47] across the United States of America, and
[00:07:49] you don't see the same level of chaos in
[00:07:51] Minneapolis, the natural conclusion is
[00:07:54] that it's not what ICE is doing in
[00:07:55] Minneapolis, it's what Minneapolis
[00:07:57] authorities are doing to prevent ICE
[00:07:59] from doing their jobs. And that's
[00:08:01] exactly what's happening.
[00:08:03] >> And Vance, of course, is right about
[00:08:04] this, too. I mean, the fact is that if
[00:08:06] local authorities were in fact working
[00:08:08] handin glove with DHS, things would go a
[00:08:10] lot smoother. Vance also pointed out
[00:08:12] that protest does not mean assault. That
[00:08:15] if you're going to protest ICE agents,
[00:08:16] that does not mean that you can obstruct
[00:08:17] federal law or go after the ICE agents
[00:08:19] physically or threaten them. A lot of
[00:08:22] these guys are unable to do their jobs
[00:08:24] without being harassed, without being
[00:08:26] doxed, and sometimes without being
[00:08:27] insulted. That's totally unacceptable.
[00:08:29] And that's one of the things that I want
[00:08:30] to send a message to is yes, come out
[00:08:32] and protest. Protest me. protest our
[00:08:34] immigration policy, but do it
[00:08:36] peacefully. If you assault a law
[00:08:38] enforcement officer, the Trump
[00:08:40] administration and the Department of
[00:08:41] Justice is going to prosecute you to the
[00:08:43] fullest extent of the law. And I wanted
[00:08:45] to show some support for these guys.
[00:08:46] >> The mayor of Minneapolis, Jacob Fry,
[00:08:49] also came out and suggested that it was
[00:08:51] absolutely terrible, awful in fact, for
[00:08:54] the Trump DOJ to indict people who are
[00:08:55] disrupting church services and entering
[00:08:58] churches without permission in order to
[00:09:00] do that. Jacob Frey tweeted, quote,
[00:09:02] "This is a gross abuse of power. The
[00:09:04] federal government is picking and
[00:09:04] choosing who to investigate going after
[00:09:06] protesters and not the person who shot
[00:09:08] and killed one of our neighbors. I'm
[00:09:09] calling for Nikima to be released
[00:09:10] immediately.
[00:09:12] Well, I mean, good for him. And I
[00:09:15] declare bankruptcy like Michael Scott.
[00:09:17] You know that and $5 will buy you a

[00:09:22] always incredible to see who the
[00:09:23] Minneapolis mayor will bow before and
[00:09:26] who he will instead allow to trample all
[00:09:30] over the law, including of course people
[00:09:33] who are attempting to violate the rights
[00:09:34] of others to worship freely in a church.
